Grasshopper

algorithmic modeling for Rhino

Where Can I find the Barend Hemmes wooden laser cut waffled light bulb grasshopper factory?

Site Administrator Note: worldwide copyright for this design has been claimed by the original artist (see this response).

I want to recreate this (see below) for a project, I have the grasshopper program but I need a factory for this or any other tips where I can generate this, I have 2 days to do it. It seems fairly easy. Well, please help.

Thanks

Patent!!!! where did i say this. I have COPY RIGHTS.

okay then to what is the copyright? for waffle structures? for light bulb shaped waffle structures? to your exact specific dimensioned shapes? to a waffle structure containing a light bulb inside???????

I was wondering the same so, I did a little research. I hope I got it right.. correct me if I'm wrong.

The copyright prevents others from purposefully copying a design. Which sim is obviously intending, even referencing the original designer. So Barend is totally right claiming his rights for the original design.

On the other hand there is nothing too original in the design. Waffling went public with structures such as Metropol Parasol way before Barend registered his design and the general shape of the light bulb is even older.

The problematic side of Barends statement is the very low structural complexity of his design. One crucial point of copyright law is threshold of originality (referring more to the source of the design than the novelty). If this object would be created by exactly copying the original design, in a way like casting templates and replicating the original, this would infringe the original creators rights.

On the other hand if someone, somehow came up with the idea of waffling a bulb-shaped solid, this design would be original. All basic steps and shapes involved to arrive at the design are pretty basic and common. In a law suit you would have to establish ignorance of the original idea (which could be difficult looking at the press section of Barends website and his design being registered at the UK Intellectual Property Office) to defend originality.

Well, "super common" would still have to hold for around 2006, as Barend filed his designs in 2007... Most hits on google are from the last 2 or so years. Then again, Metropol Parasol was designed in 2004. ;)

Hi Hannes

Thank you for shedding light on this matter.

Had the individual contacted me directly and asked to collaborate or at the very least my permission he have found that I am a pretty easy going person.

Regards barend

Patenting and copyright are pretty difficult concepts to argue about. Cases like the infamous evolute patents really make the whole concept seem like a money machine.

On the other hand, I can totally understand the position of any artist or engineer trying to make a living off his creations.

Do not know much about patent law but I think the spirit of this forum is to learn. regards

Dear Barend Hemmes,

I'm fully aware of your product and copy right laws issued with your product. I am currently a student and I was conducting a project for a course. This course was instructing us on the uses of computer software and it's application in the design process, as we were learning the application of this software, I used your design in order to learn the software. I have no intention of reporducing your design for malicious purposes, I only utilized your design as an aid, a guide in learning a software.

I too have plans of becoming a designer in whatever form that realizes, I know that my livelihood depends on my intellectual property; so I respect your concern for yours. I respect your design aesthetic and value the work that you do.

That is all I have to say regarding the matter, I hope you do NOT find this in offense, although meeting under less positive pretenses I intend on turning that into something positive and hope to build a positive relationship with you.

Regards Sim Odu
