Curve to surface

Hi everyone, 

I've been trying to create a surface dictated by a joined curve, but I cant's seem to do this, seeing as it is not planar, this might not be possible.. what I want to do essentially is cut out of this surface with a scaled curve through surface split, but right now these are meshes.. 

So is there any way of converting this closed curve to a surface?

Or better yet.. is there anyway to cut out of a mesh using a curve? Because meshsplit can only cut with other meshes..
